In this work I propose an initial model of argumentative complexity from the theoretical framework of text linguistics. For this purpose, I have explored aspects of both the ability underlying the activity of speaking (the ἐνέργεια) and the product created by this competence (the ἔργον). The work supports the hypothesis that the ability or level of the ἐνέργεια is related to formal argumentative complexity (ἔργον) in many discourses. Broadly, this relationship has been only partially addressed. In order to account the (...) generative capacity (ἐνέργεια), I show some cases of the score in the Tasks in Critical Thinking Test obtained by university students, as well as the product (ἔργον) the same subjects produced. This product, an essay, has been analyzed qualitatively following the procedures of the grounded Theory. The results showed that the subjects with higher scores in the ability of ἐνέργεια produced more intricate essays, in terms of argumentative complexity. This research constitutes an initial endeavor to establish a normative model of the notion of “argumentative complexity”. (shrink)

El presente trabajo tiene como objetivo determinar los tipos de actividades de reformulación conversacional que aparecen en conversaciones en adultos mayores con diferentes niveles de desempeño cognitivo: normales y trastorno cognitivo leve, a partir de una tarea de construcción de un discurso narrativo-argumentativo. Desde una perspectiva de investigación cualitativa, se obtuvo un corpus de 4 entrevistas, que fue codificado con la ayuda del software ATLAS.ti lo que permitió la generación de conceptos y el desarrollo de explicaciones a partir de los (...) datos, los que fueron contrastados con el marco teórico disponible. Los resultados indicaron que los hablantes realizaron actividades de auto-reformulación auto-iniciada, auto-reformulación iniciada por otro y hetero-reformulación derivada del auto-inicio. Las dos primeras se redujeron en los hablantes identificados con trastorno cognitivo leve, mientras que el último tipo de actividad fue el más frecuente y dominante en la conversación. Los hablantes con trastorno cognitivo leve realizaron reformulaciones que no corregían o adecuaban el discurso, por lo que no cumplieron con la finalidad de la reparación. This study aimed to determine the types of activities of conversational reformulation that occur during oral dialogues with older adults who have varying levels of cognitive performance. Study participants, who ranged between normal cognitive function and mild cognitive impairment, were given the task of constructing a narrative-argumentative dialogue. For qualitative investigation purposes, a corpus of four interviews was obtained. Each series of interviews were encoded using ATLAS.ti software which generated linked concepts and explanations from the data. Findings were then compared with the available theoretical framework. The results indicated that participants exhibited three modes of reformulation technique: self-initiated self-reformulation activities; self-reformulation started by another person; and hetero-reformulation derived from self-start. The first two were reduced in speakers exhibiting mild cognitive impairment, while the latter was the most frequent and dominant mode in the conversation. Speakers with mild cognitive impairment executed reformulations that did not correct or enhance the speech, and as such did not meet the purpose of reformulation. (shrink)

This work pretends to unveil the relationship between the psychosocial features grouped under the argument frame concept and the degree of discursive density that is reached by a sample of 243 older adults in the production of argumentative discourses. In order to specify the main psychosocial features of the sample’s subjects, the Hample test was employed. In order to evaluate argumentative density, all of the participants were asked for an essay about a controversial situation derived from the Dilemma of the (...) D.I.T. Questionnaire. The information crossover between both instruments allowed the establishment of a significant relationship between the way in which the older adults frame reality and the discursive products through which it is communicated. Durante los últimos años se ha producido un proceso migratorio sin precedentes hacia Chile, situación que ha modificado en cierta medida la ecología social, por medio de la introducción de discursos de variadas procedencias dialectales. En esta línea, el trabajo ha descrito el comportamiento discursivo argumental de la ecología de inmigrantes colombianos, peruanos y venezolanos de la Región Metropolitana y de la Región Coquimbo, Chile (Zona Centro Norte). A partir de una entrevista cualitativa estructurada, 160 participantes expresaron su punto de (...) vista frente a una situación de autoimplicación (la pandemia Covid-19); enseguida generaron argumentos justificatorios del punto de vista inicial; y finalmente, generaron la conclusión (_peroratio_) en la forma de una secuencia de discurso. El análisis permitió observar que el esquema de razonamiento sintomático asociado a la generación de argumentos _ad misericordiam_ y de identidad caracteriza específicamente el discurso de los hablantes colombianos, peruanos y venezolanos. Por otra parte, se pudo observar que el empleo de esquema instrumental en la forma de argumento de tipo causal parece ser la vía de resolución de conflictos más amplia para esta ecología discursiva específica. In this paper, we raise two points. First, any rights‐based theory should provide a method by which to guide reasoning in addressing conflicts of rights. The reason, we argue, is that these theories must provide guidance on what should be done. Second, this method must contain two key recommendations: (1) We should try to find a deliberative mechanism through which none of the rights is simply eliminated from the scene; (2) these rights may be balanced against each other to define (...) which right should prevail, but without considering non‐rights‐interests as if they were rights in the process. These recommendations instantiate two crucial principles that underlie our common intuitions on rights, namely, the principle that rights deserve equal respect and the principle that rights should be taken seriously. In this paper, we analyze the relationship between the logic of gift and team performance. We explore this connection empirically, using a detailed data set from the National Basketball Association. In particular, we use the NBA Cares Community Assist Award as a way to measure gift-giving to the community. We explore the response of an entire team after one if its members has been recognized for his gift-giving behavior. Using two winners, we show that after a player has received the (...) award there is an increase in the number of assists given by each member of the team, and that there is also an increase in the number of wins. Therefore, our results show that the team’s performance would improve after a player has been recognized because of his gift-giving attitude. This finding to management implies that managers’ incentivization of a sharing and giving philosophy would not only improve their relationship bond but it would also help them increase their performance. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). Interest in ethical aspects associated to product acquisition and consumption is a growing trend among consumers. In this context, the concept of “product with ethical attributes” has arisen to refer to products with explicit social and environmental characteristics. However, one of the factors that most hinders the purchasing of these products is certainly price. Given the difficulty of reducing price, the question that arises is the extent to which other product attributes can attenuate the negative impact of price on perceived (...) value. We assume that the special benefits associated to this type of products are, at a different level, attenuators of the relationship between price and perceived value. Focusing on Fair Trade organic coffee, hypotheses are tested regarding survey data from 407 customers. They were interviewed in an actual purchasing scenario. The models are tested using conventional Structural Equation Models and the Latent Moderated Structural Equation method. The results obtained shed some light on a highly generalised belief that the marketing of these products can only be improved by reducing their price. However, although a price reduction could be desirable, albeit complicated in this product category, its effects could be reduced by acting on other variables such as the ethical aspects, quality and healthiness of this product category. The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

The aim of this work is to contribute to elucidate Wittgenstein’s conception of Judaism. It is generally acknowledged that Otto Weininger’s work influenced the thought of Wittgenstein, but there is no agreement on the content of that influence. Here we argue that it is perceptible not only in the wittgensteinian conception of ethics, geniality, talent, etc., but also in his characterization of Judaism and the way the philosopher uses this idea.

Cet article présente le projet de recherche international « Le monde atlantique comme laboratoire conceptuel . Fondations pour un Dictionnaire historique de la langue politique et sociale dans l'espace ibéro-américain» , qui réunit plus de 60 chercheurs en Europe et en Amérique latine. Son objectif est d'effectuer une étude comparée des concepts politiques de base tels que América/ americanos, constitución, etc. Il analyse les modes de conceptualisation et de traduction/adaptation des vocables d'une même langue d'un pays à l'autre, et les (...) différences qui apparaissent entre les deux grands blocs politico-linguistiques que sont l'Espagne et l'Amérique hispanique d'un côté et le Portugal et le Brésil, de l'autre. L'article s'achève par l'examen du terme d'opinion publique et de ses liens avec les autres concepts du projet.This paper presents the international research project "The Atlantic world as a laboratory concept . Foundations for a Historical Dictionary of language and social policy in the Ibero-American ", which brings together more than 60 researchers in Europe and Latin America. Its objective is to make a comparative study of political concepts such as basic América / americanos, constitución, etc.. It analyzes the modes of conceptualization and translation / adaptation of the words of the same language from one country to another, and differences appear between the two major political blocs that are language-Spain and Hispanic America one side and Portugal and Brazil on the other. After the coup d’état in 2012, the Malian state experienced progressive decomposition in terms of loss of territorial integrity as well as in the functioning of its institutions. Against this backdrop, this article examines life histories of a former student generation whose members were actively involved in the protest movement of 1980. At the time they fought for student rights and democratization under a military junta, but were not able to induce the desired change. Today they portray themselves as committed (...) patriots for whom the state serves as an ongoing point of reference in their identity constructions. Bringing together higher education, protest movement and state decline, I argue that their narratives not only reveal how damaged identities and political visions are narratively repaired, but also, on a symbolic level, their damaged country as well. The forfeiture thesis is posed as an independent thesis in moral philosophy according to which agents forfeit (or lose) rights if they perform certain act-types. According to many, this thesis plays a crucial role in the justification of (legal) punishment. In this paper, I argue that the forfeiture thesis is unnecessary – we can simply dismiss it without any substantive loss. Echoing an aspect of the specificationist approach to rights, the reason is that we may replace the forfeiture thesis with (...) an exception clause in the very content of the right not to be subjected to hard treatment: P has no right not to be subjected to hard treatment simpliciter, but a right not to be subjected to hard treatment unless P performs an act-type φ – e.g., murdering an innocent person. This alternative has substantive advantages over the forfeiture thesis, which, in turn, shows that the former cannot be reduced to the latter. (shrink)

The much-discussed “claimability objection” holds that it is unjustified to believe that all individuals have a human right to subsistence because the bearers of the correlative duties are not sufficiently determined. This argument is based on the so-called “claimability-condition”: S has a right to P if and only if the duty-bearer is sufficiently determined. Practice-based theorists defend the human right to subsistence by arguing that if we take the existing human rights practice seriously, there is no indeterminacy about the allocation (...) of duties. In this paper, I challenge this (apparently compelling) defense of the human right to subsistence with a dilemma. If the claimability condition is true, the practice-based defense fails to undermine the claimability objection because the duty-bearer is determined in some, but not all, cases. If practice-based theorists reject the claimability condition, they generate an account of human rights that is problematic from the practical perspective because it may contain duties that are unable to guide action. The role of prefrontal cortex (PFC) in influencing creative thinking has been investigated by many researchers who, while succeeding in proving an effective involvement of PFC, reported suggestive but sometimes conflicting results. In order to better understand the relationships between creative thinking and brain activation in a more specific area of the PFC, we explored the role of dorsolateral PFC. We devised an experimental protocol using transcranial direct-current stimulation (tDCS). The study was based on a 3 (kind of stimulation: anodal (...) vs. cathodal vs. sham) X 2 (priming: divergent vs. convergent) design. Forty-five healthy adults were randomly assigned to one stimulation condition. Participants’ creativity skills were assessed using the Product Improvement subtest from the Torrance Tests of Creative Thinking. After 20 minutes of tDCS stimulation, participants were presented with visual images of common objects. Half of the participants were instructed to visualize themselves using the object in an unusual way (divergent priming), whereas the other half were asked to visualize themselves while using the object in a common way (convergent priming). Priming was aimed at inducing participants to adopt different attitudes toward the creative task. Afterwards, participants were asked to describe all of the possible uses of the objects that were presented. Participants’ physiological activation was recorded using a biofeedback equipment. Results showed a significant effect of anodal stimulation that enhanced creative performance, but only after divergent priming. Participants showed lower skin temperature values after cathodal stimulation, a findings which is coherent with studies reporting that, when a task is not creative or creative thinking is not prompted, people show lower levels of arousal. The involvement of dorsolateral PFC in creativity has been supported, presumably in association to shift of attention modulated by priming. (shrink)

Um marco sobre a questão do tempo na História da Filosofia, o livro XI das Confissões de Agostinho de Hipona (354–430) ainda hoje recebe interpretações. O presente artigo menciona pontos que já apresentei noutro texto sobre o tempo como espelho da alma, no entanto ele recebe o acréscimo de dois pontos que mudam a ênfase de minha interpretação prévia: (1) a citação a Josué e (2) a escolha de Deus creator ominum para exemplificar a relação, via tempo, entre ser humano, (...) Deus e o mundo. Mediante a análise textual do livro XI, a seguinte conclusão será encaminhada: embora Agostinho não recuse a existência do tempo como uma realidade independente das vivências humanas, ele privilegia outro aspecto do tempo, medular nas Confissões, a saber, a relação humana com o tempo em correspondência com a intenção da vontade pela qual a vida humana é governada. Em Agostinho, o tempo da vida se compromete com a ética, e reflete o modo como a vontade habita a vida. Tempo e alma, nas Confissões, são interdependentes a ponto de a experiência humana do tempo ser um espelhamento da vontade. (shrink)

Está organizado por el alumnado de cuarto curso del grado en Publicidad y RR.PP., con la coordinación directa del profesorado. El objetivo de esta publicación es conocer la valoración de aquellos exestudiantes que han participado, y conocer qué competencias han desarrollado de cara a su vida profesional. Within the Caribbean literature, the imaginary—a very often defined notion—is presented in a new light by the fictional and theoretic thought of Patrick Chamoiseau. The imaginary dimension can’t remain something abstract and essential full of invariants. Chamoiseau is mistrustful of the mythical imaginary, however he doesn’t put an end to it but he opens a literary space where everything has to be created. In Chamoiseau’s works, the imaginary dimension is of the highest importance in an ideological battle-field where the main (...) character is the Warrior of the imaginary. His ambition is to switch from monolingualism to multilingualism, therefore the French and the Creole languages—we can read in his writing—crystallize the new and always changing definitions of the imaginary. Cet article interroge la dimension temporelle de l’activité de représentation politique. En s’intéressant aux projets de limitation de la réélection des parlementaires en France et aux _term limits_ états-uniens, il met en évidence les conflits et intérêts qui s’articulent autour de la codification temporelle des mandats. L’idée de limiter le nombre de mandats parlementaires successifs autorisés n’emporte pas l’unanimité : les débats mêlent à la fois des anticipations des effets de la règle sur les pratiques politiques et des croyances à (...) propos de la démocratie. The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

Across contexts and time, subjects marked by racial difference have expressed public accounts of the multiple injuries of race. From the vantage point of critical race and black theory, this paper sheds light on both the heuristic and critical political values of such accounts. The first part critically reassesses conceptualizations of vulnerability as an ambivalent ontological condition within critical approaches to liberalism. A close reading of Fanon's account of injury in Black Skin, White Masks specifies how race exploits bodily and (...) enunciative vulnerability and materializes subjects into a state of suspension and suspicion. The second part addresses the political promise of accounts of racialized injury. Departing from sceptical readings of “wounded attachment,” critical race and black analyses associate accounts of injury with citational practices that pertain to historically entrenched conventions of resistance to racial and colonial abusive power. Such accounts can be read as misappropriations of race which expand the horizon of the human. (shrink)

El presente texto tiene como propósito analizar teórico-conceptualmente las prácticas pedagógicas de la ética implementadas por los docentes en la universidad tradicional y la universidad popular en los años 2010 – 2020. Teniendo en cuenta, primero, las características inherentes de la universidad tradicional tanto en sus orígenes y principios fundamentales; segundo, las practicas pedagógicas de la ética en el rol docente; y tercero, el advenimiento, desarrollo y propuesta de la Universidad popular. Mediante este análisis fue posible develar los paralelismos entre (...) sus divergencias y puntos de encuentro con base en la ética-práctica del rol docente, para el mejoramiento continuo tanto de esta área del conocimiento como de los demás saberes en general. Entre 1843 y 1844, uno de los conceptos centrales del pensamiento de Karl Marx es el de ser genérico. Es indudable en este concepto la herencia terminológica feuerbachiana, cuya principal referencia es el concepto de género. Sin embargo, este trabajo muestra que en su funcionamiento el ser genérico, lejos prolongar el concepto feuerbachiano, implica su refutación. Esto permite comprenderlo en una problemática más amplia de la obra de Marx: el proceso histórico de sustitución de las interrelaciones fundantes de los cuerpos (...) por su forma representada. This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. En este artículo defendemos la existencia de un perspectivismo ontológico pluralista inherente a la filosofía de Baruch Spinoza. Indispensable para la constitución de esta noción es la relación establecida entre su teoría general de composición de los cuerpos y los conceptos de “afecto”, “inmanencia”, “potencia” y “multitud”. El objetivo de este análisis es una fundamentación interior del concepto de “puntos de vista”: es imposible pensarlo como una característica epistemológica de un individuo aislado, pero tampoco es posible unificarlo mediante el postulado (...) de una propiedad común. En consecuencia, el perspectivismo ontológico espinosista implica una teoría del punto de vista pluralista que elude los problemas planteados por la clausura del modelo Uno-Todo. (shrink)

Con una indagación cualitativa se intenta averiguar si el método de palabras generatrices de Paulo Freire presenta ventajas para la enseñanza-aprendizaje de la lengua escrita castellana en la edad infantil. Se extraen los datos de la experiencia práctica acumulada por profesorado que lo ha aplicado en el segundo ciclo. Cinco maestras aportan informes escritos individuales y dos equipos docentes se constituyen en grupos de discusión. Tras la categorización y análisis de los datos, se concluye que el método tiene muchas ventajas. (...) Entre las ventajas de tipo didáctico cabe resaltar el respeto al protagonismo del alumnado y a su pensamiento sincrético, ser muy motivador, conseguir la comprensión lectora desde el principio, desarrollar simultáneamente las conciencias léxica, silábica y fonológica; enriquecer el vocabulario, fijar una ortografía correcta, integrar todos los ámbitos de conocimiento, y desarrollar la capacidad simbólica y la creatividad. Como ventajas de tipo pedagógico: considerar los efectos de tipo actitudinal que actúan sobre los procesos cognoscitivos, adaptarse a los contextos, permitir al profesorado conocer mejor a su alumnado, propiciar el desarrollo de la dimensión afectivo-emocional, favorecer la socialización por trabajarse siempre en grupo y la ayuda entre iguales, el buen clima de aprendizaje y la colaboración familiar. De acuerdo a esta determinación es posible advertir el límite de la téchne a partir de la cuestión socrática de la virtud. La virtud, en la medida que no es un asunto análogo a los objetos de la téchne, precisa de un especial acceso. Desde la constatación del diálogo como el único modo de conocer la virtud, se pone de relieve su sentido comunitario y (...) el carácter del examen socrático. En el diálogo socrático se anuncia, así, que la virtud no es nunca algo técnicamente clausurado ni epistémicamente conceptualizado, sino el mayor bien humano que se cumple en su aproximación a través del examen conjunto de la propia vida.: This article starts by recognizing the protective nature of téchne and its development. It is thereby possible to understand the limits of téchne based on the Socratic question of virtue. Virtue, insofar as it is not a matter analogous to the objects of téchne, requires a special access. The communitarian sense and the character of the Socratic inquiry are made plain, given dialogue as the only way of knowing virtue. Socratic dialogue discloses that virtue is never technically closed or epistemically conceptualized, but that this greatest human good is fulfilled through the joint examination of life itself. Aunque el contenido del Eutifrón se revela en saber qué es la piedad, este diálogo, pese a una inevitable apariencia, no tiene como fin último proporcionar una definición proposicional de este fenómeno. La piedad se pone al descubierto a partir de la dialéctica de Sócrates, cuya insistencia en volver al principio del problema no proviene de una incapacidad del interlocutor de definir el asunto, sino de la debilidad misma del discurso. La necesidad de plantear otra vez desde el principio la (...) cuestión suscita en el intérprete advertir la importancia de la ejecución misma del diálogo como testimonio y acreditación de su propio contenido. This paper discusses the limitations, omissions and value judgements of the application of conventional economic analysis in the evaluation of climate change mitigation policies. It is argued that these have biased the result of the assessment models towards the recommendation of less aggressive mitigation strategies. Consequently, this paper questions whether they provide appropriate policy recommendations. The unequal distribution of rights implicitly assumed in conventional economic analyses applied to climate change is questioned and an alternative approach considering a distribution of rights (...) consistent with sustainable development is put forward. Finally, the points that an analysis consistent with sustainable development should take into account are presented. (shrink)

De ce a fost fondată Uniunea Europeană? Un prim răspuns ar fi dorinţa de pace după un război devastator şi umilitor. Un al doilea răspuns ar fi realizarea importanţei unităţii. O unitate care se va caracteriza printr-o diversitate a culturilor şi a limbilor. Statele europene nu au dorit să renunţe la suveranitatea lor, au vrut să devină un corp comun pentru a nu a mai putea fi călcate în picioare de iureşul istoriei. Ca orice unitate, UE avea nevoie de un (...) cadru de reglementare oferit de instituţii şi politici europene. De asemenea, pentru a armoniza ceva trebuie să poţi pune împreună anumite elemente separate. Armonizarea Uniunii a fost realizată prin fondarea instituţiilor şi a reglementărilor acestora (structura instituţională a UE este prezentată în Anexa nr. 1). Instituţionalizarea Uniunii Europene este cheia de boltă a construcţiei istorice europene. Început în anul 1957, acest proces a lăsat urme adânci în conştiinţa politică europeană. Dacă la început a fost privită cu reticenţă, acum Uniunea nu poate exista fără instituţii. (shrink)

The aim of this article is to examine the problematic frontier that separates the phenomenology of the body and the phenomenology of animality. The main difficulty is to differentiate phenomenologically not only between embodiment and animality, but also between specifically human embodied experience and what is accessible to us through empathy in relation to the corporeality of the animal. I will tackle these questions by considering relevant textual material from the writings of Edmund Husserl and Martin Heidegger. On the one (...) hand, I will show that although embodiment and animality are convergent on the level of the naturalistic attitude in Husserl’s Ideas II, they are divergent as soon as we place ourselves in the personalistic attitude, where the body enters into a different conjunction—namely, with the idea of person and of the spiritual world. On the other hand, Heidegger claims that, in spite of the abysmal bodily kinship with the animal, there is an essential difference between the human body and the animal organism, thus opposing the tendencies to humanize the animal and to animalize the human. Barnes (2014) has argued in this journal for the following conditional: If there is any metaphysical indeterminacy, this must be at the most fundamental level of reality. To argue for this claim, Barnes relies on two principles that I shall call bivalent completeness and determinate link. According to the former, a complete description is a bivalent assignment of truth values to every sentence. The determinate link, instead, establishes that the determination relation between levels of reality preserves determinacy from one level (...) to another. In response to Barnes’ conclusion, Eva (2018) has recently pointed out that bivalent completeness is question begging. In this paper, I will first show why Eva's line of reasoning can be resisted. My aim will then be to present a stronger case against Barnes’ argument by challenging the determinate link. In the presence of metaphysical indeterminacy, the link between fundamental and derivative facts might itself be the locus of indeterminacy. I will conclude by showing that Barnes and Eva make many unwarranted assumptions regarding both indeterminacy and fundamentality. The logical space around the connection between these two notions appears to be much wider than what they seem to be aware of, or so I will argue. (shrink)

What are the main conditions that any theory of human rights should satisfy to guide action? If agents must take action for a fairer world as human rights discourse suggests, this is a crucial question to reflect upon. In this paper, I make a proposal. I argue that any theory of (moral) human rights that guides action on the basis of correlative duties must satisfy three key conditions. The first condition is focused on the specification of act-types, the second concerns (...) the distribution of correlative duties, and the third is focused on the resolution of (resolvable) conflicts of human rights. I show that this proposal has substantive implications because it implies to reject, challenge and, in some cases, resist ideas that are commonly accepted in the literature on human rights. (shrink)
